Adv.UPON hearing counsel the Court made the following

ORDER
  • Learned senior counsel appearing for the petitioner submits that despite the passing of the Building and other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, no steps have been taken either by the State Governments or their respective labour department in regard to constitution of State Advisory Committees, Expert Committees etc.
  • It is also submitted that many of the States have not even framed the Rules. It is submitted that cess is not being collected and even in States where some cess is collected, it is not being used for the purpose for which it is meant.
  • We, therefore, direct the Secretary of the Labour Department of each State to submit a detailed report within eight weeks as to what steps have been taken in this regard and the reasons for non-implementation of various provisions of the Act.
  • Office will send a communication to the various Chief Secretaries/Labour Secretary of each State in regard to implementation of the provisions of this beneficial legislation. List in August, 2008.
